Your use of a downloaded product from Beech Tree Books (“Product”) is conditioned upon your prior acceptance of the terms of this Agreement.
You agree that the Product, including but not limited to music, lyrics, characters, graphics, audio clips, and editorial content, contains proprietary information and material that is owned by Beech Tree Books and/or its licensors, and is protected by applicable intellectual property and other laws, including but not limited to copyright, and that you will not use such proprietary information or materials in any way whatsoever except for use of the Product in compliance with the terms of this Agreement. No portion of the Product may be reproduced in any form or by any means. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Product in any manner, and you shall not exploit the Product in any unauthorized way whatsoever.
The Product is for sale to end user customers only. You shall be authorized to use the Product only for personal, noncommercial use. Resale or any commercial use is strictly prohibited. Technologies may be used to verify compliance. Any burning (if applicable) or exporting capabilities are solely an accommodation to you and do not constitute a grant or waiver of any rights of the copyright owners to any of the audio content, underlying musical composition, or artwork embodied in the Product. The delivery of the Product does not transfer to you any commercial or promotional use rights to the content, associated artwork or other materials.
You agree that you will not attempt to, or encourage or assist any other person to, circumvent or modify any security technology or software that is part of this site, its products or its administration.
All sales are final.
Purchase of this Product is made via secure Paypal transaction. Billing to your Paypal account (or credit card through the secure PayPal transaction gateway) will occur at the time of purchase or shortly thereafter and appear on your statement as “BEECH TREE BOOKS”.
You acknowledged that use of this Product may require the use of other hardware and software products or playing devices, and that such devices are your responsibility. Once the Product is purchased and you have received it, it is your responsibility not to lose, destroy, or damage the song, and Beech Tree Books shall be without liability to you in the event of any loss, destruction, or damage. The Product is not combined with any other product or offering, and no purchase or obtaining of any other product shall be construed to guarantee your access to the content. You acknowledge that Beech Tree Books shall have no liability to you in connection with any damage to your hardware or software products or playing devices that may be caused by the Product.

All sales are governed by New York law, without giving effect to its conflict of laws provisions.

THE USE OF THE CONTENT OR ANY PART THEREOF, EXCEPT AS PERMITTED IN THESE TERMS OF SERVICE, IS STRICTLY PROHIBITED AND INFRINGES ON THE INTELLECTUAL PROPERTY RIGHTS OF OTHERS AND MAY SUBJECT YOU TO CIVIL AND CRIMINAL PENALTIES, INCLUDING POSSIBLE MONETARY DAMAGES, FOR COPYRIGHT INFRINGEMENT.
